Foster Families; CPS Violations? 2 of 8 - National Foster Families | Examiner.com
In part 1 of this series we looked up one definition in Baron’s Legal Dictionary; malfeasance. Now let us continue with our investigation and foundation into our subject;
Why would we look up that particular word? You see, one must try to describe what we see taking place within this system originally designed to care for those children who were being abused it matters not who was doing the abusing it is our job to protect them. Question; in our attempt to protect childdren have we now unleashed a greedy green eyed monster upon these children and their parents? Has the entity created to protect instead become a multi billion dollar business, an outlet to sell a commodity much in demand. Is CPS committing violations usurping the rights of our citizens?
Important words defined; malfeasance, malice, misuse of and even maliciousness of office. Did you read our article called Malice of office. Please read the article. Now let us give a brief description of two words;
2. Malice ; intentional wrong doing of a wrongful act without justification with disregard harm will result or when the maker recklessly disregards the truth or falsity of it
3. Malicious arrest/ Malicious prosecution; an action recovery of damages that have resulted to person, property or reputation from previous successful civil or criminal proceedings that were prosecuted without probable cause and with malice. (Definitions from Barron’s).
Example given; Martha wants to persuade her estranged husband Eugenio to pay her a generous alimony and child support. She contrives a story, which she tells the local prosecutor, connecting Eugenio with child abuse. Her misuse of the criminal process is an example of malicious prosecution, for which Eugenio may be able to sue her.
Definition; A tort, in common law jurisdictions, is a wrong that involves a breach of a civil duty owed to someone else. It is differentiated from criminal wrongdoing, which involves a breach of a duty owed to society. Wikipedia
Question; is it malfeasance of office if a social worker wrongfully removes your children on a whim, based only on an anonymous call?
Remember the definition; This is an unlawful act; wrongdoing, especially a violation of the public trust by a public official.
We all know what unlawful means, or do we. Just for fun let us look it up. The word law is defined as; Law[4]is a system of rules and guidelines, usually enforced through a set of institutions.
