STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT requiring a performance audit of the guardian ad litem board and guardian ad litem services.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Performance Audit of the Guardian Ad Litem Board and Guardian Ad Litem Services.

I. In addition to any other performance audit requirements, the audit division of the legislative budget assistant shall complete a performance audit of the guardian ad litem board and guardian ad litem services. The audit and the resulting report shall be completed no later than November 1, 2011, and shall include an assessment of:

(a) Governance and board membership.

(b) The application, certification, and preservice and continuing education requirements for guardians ad litem.

(c) The adequacy and appropriateness of the existing fee structure.

(d) The adequacy of program monitoring and oversight mechanisms, including complaint resolution procedures and associated fees.

(e) Education and training requirements, including the scope and comprehensiveness of training in family dynamics, child and adolescent development, preparing evidence/fact based reports for the courts, criteria for and process by which families are referred for clinical and other services, and any other matters as may pertain to improving the quality of services.

(f) The role of the supreme court in regulating the certification, qualifications, training, standards, oversight, and decertification of guardians ad litem.

II. The legislative budget assistant shall submit the final report of the performance audit to both the joint legislative performance audit and oversight committee and to the fiscal committee of the general court, for transmission to the governor, the speaker of the house of representatives, and the president of the senate.

2 Effective Date. This act shall take effect 60 days after its passage.
