Federal Class Action Lawsuit Filed Against State Bar Association

Citizens Demanding Justice: ***BIG NEWS****Federal Class Action Lawsuit Filed Against State Bar Association:

Some good news to share with everyone interested in family law reform.


Legislation is introduced in Maryland in 2010 and 2011 calling for a presumption favoring equality in custody cases in the family courts. The bill never makes it out of committee for a vote. Legislation is introduced in 2010 in the state of Tennessee calling for shared parenting and presumptive equality in custody cases in the family courts; it fails to move out of committee. In 2011 legislation overhauling Alabama court custody practice is introduced; the bill goes nowhere.

Legislation is introduced in Minnesota in 2012 calling for increasing the time sharing presumption for children with both parents in child custody cases. After being watered down, legislation passes the House and Senate overwhelmingly, only to be vetoed by the governor. In 2011 and 2012 legislation is introduced in South Carolina providing for shared parenting. The bills give way to a compromise bill that requires parenting plans, and creating a study committee to recommend further changes to the statutes, but removes language that would mandate children spend significant time with both parents. Child custody reform legislation in North Dakota, Virginia, Ohio, Texas, Michigan, Nebraska and other states is introduced but is killed in committee or never given serious consideration.

Just what is going on here? And what does a class action lawsuit have to do with child custody legislation?

Those engaged in family law reform know one of the primary opponents of shared parenting are state bar associations. In every instance above where legislation was introduced the family law sections of the state bar association stood opposed. The bar associations in each of these states lobbied aggressively against bills providing children a fuller relationship with both parents.
Lawsuit Alleges Lobbying by Bar Associations Impermissible Activity

A new class action lawsuit filed against the Nebraska State Bar Association alleges lobbying activity by its state bar association violates the civil rights of attorneys who do not agree with the positions advocated. The suit further alleges that requiring attorneys to pay dues to the bar association as a condition of practicing law in the state, and then using those dues for broad based lobbying is an impermissible activity.

Mountain States Legal Foundation has filed suit against the Nebraska State Bar Association on behalf of Nebraska State Senator Scott Lautenbaugh. Senator Lautenbaugh is an attorney licensed to practice in the state of Nebraska. Senator Lautenbaugh also supports reforming family law and giving children a fuller relationship with both parents. Senator Lautenbaugh is tired of the state bar association coming over to the legislature and lobbying for or against legislation. Senator Lautenbaugh, on behalf of over 1,100 attorneys in the state of Nebraska, is seeking to restrict the state bar association’s lobbying activity, not just as it relates to family law legislation, but in many areas. We ‘tip the hat’ to Senator Lautenbaugh and support his efforts to end abuse of the public and legislative processes by the bar association.

While this case has been filed in federal court, the Nebraska Supreme Court is also showing interest in the activity of the bar association and has ordered it to provide detailed records of how it is spending members funds, particularly focusing on the bar’s lobbying expenditures.
Over 80% of the states listed at the beginning of this article have integrated state bar associations that engage in the same type of activities as the Nebraska bar. This lawsuit is important to citizens in a number of areas, family law being just one. We’ll keep you informed as the suit develops.

Silly question. The same reason they get away with everything else. Because, as they say, "Our Government gave them the power to do whatever they want." "They have the Power of God." "They walk on water.". Last but not least, they are accountable to NO-ONE!
The picture below is an adoption brochure put out by NH DCYF. The picture is of my Stolen grandson Austin, advertising him like a dog. Refusing to place him with the family member's Nashua DCYF slandered. Not only were these brochures made advertising him and other children for the adoption block, huge poster's along with the brochures were placed in businesses and specifically in the lobby of Nashua DCYF's cohort hospital. The hospital that work's closely with Nashua DCYF. The hospital where at least one of the Social Worker's work's for DCYF teaching a Foster care class and has had many Foster children throughout the years. You might say this is a conflict of interest. You're right. It is! So is Human Trafficking legal in NH? It sure look's that way doesn't it?!

Finally some visibility.  What the normal public views as a conflict of interest, was meet by the short term of a Commissioner Morton, when he accused Sylvia Gayle of a conflict of interest. You have to read these findings to believe it and see the bias compared to the next set of links and findings under other Commissioner's, this board is anything but consistent, but some very useful findings in additional to the one on a Tracy Roukey, a CPSW found under demotions (really, what took so long).

Nashua DCYF Tracy Roukey Demoted For Offenses But What About the Other's Guilty of the Same Offenses?

Thank's to a well-known NH Paralegal and Family Advocate, Denise-Marie McIntosh, I was just recently made aware of the appeal of Nashua DCYF worker Tracy Roukey on her demotion of August 25, 2010, from Supervisor IV to CPSW III.

After reading her appeal, I was in total shock and am baffled as to the demotion of one Supervisor when so many more Supervisor's in the same Nashua Office are guilty of the same offenses. I ask myself, "Why was Tracy Rouky singled out?" I know some parent's believe she deserved to be demoted, but what about the rest of the Nashua Supervisor's, also guilty?
I in no way am condoning any of Tracy Roukey's alleged offenses, but I believe what's good for one is good for the other. So why wasn't the Nashua Office completely overhauled?

One of the offenses mentioned in the appeal was she failed to properly supervise and direct [her] Child Protective Service Worker (CPSW) staff so that incarcerated parents and uncooperative parents are engaged in the case planning process for their children, which is in directive [sic] violation of DCYF best
case practice."  Oh and isn't this merely an Administrative Rule? Administrative Rules that DCYF feel they don't have to abide by?

That's strange because former Supervisor (Assessment worker) Melissa Deane was guilty of the same offense when she stole my granddaughter and assigned CPSW Kris Geno to my daughter's case. My daughter was never included in the case planning. Everything DCYF expected her to do was already written up by Kris Geno. My daughter had no say and was threatened by Kris Geno to sign it or never see her daughter again.

When Melissa Deane signed the Title IV-A application for parent's on TANF, eligible for TANF or signing up for TANF, because my daughter refused to because she was none of the above, why wasn't she demoted or even fired?
When Melissa Deanne admitted in Court she had no idea my daughter was given Morphine in labor, (which spilled into the baby) and admitted she had no clue as to ALL the medical problems my daughter suffered from throughout her pregnancy, why wasn't she demoted or fired?
Wasn't Melissa Deane also responsible for CPSW Kris Geno when she perjured herself in Court, when she stated my daughter wasn't being drug tested and her LEGAL Methadone doses and levels weren't going down, yet her own contact log's and drug test report's show the opposite? After perjuring herself in Court, is it at all normal to tell the Foster stranger's,"Don't worry. There's no guarantee she's going anywhere." Was she following Melissa Deanes order's or was she being paid off?
Wasn't Melissa Deane responsible for CPSW Kris Geno when she told my daughter not to tell anyone her daughter was half Spanish? And why is being half Spanish a problem? Why should being half Spanish be kept a secret? No demotion and no loss of job.
Was Melissa Deane responsible for a fictitious mans rights being terminated instead of my granddaughter's REAL Father? She's no longer working there, but was she demoted or fired?

Another Supervisor (Assessment worker), Eric Corliss was guilty of the same offense when my other two grandchildren were stolen from my other daughter and CPSW Anna Salvatore Edlund was assigned to her case. My daughter was never included in the case planning either and she was also told by Anna to sign or never see her children again. Was Eric ever demoted or fired?

Was Eric Corliss overseeing CPSW Anna Salvatore Edlund when she followed my daughter for a week and  told her and her husband if she didn't move out of their apartment they would never see their kids again?
Was Anna following Eric's order's when criminal charges were dropped against my daughter due to new found evidence, yet Anna and the CASA worker vowed to make sure the kid's weren't returned?
Was Eric the person responsible for a fictitious mans rights being terminated instead of my grandsons REAL father?
 And what about the CPSW's who fail to visit children in foster homes? Who fail to fully investigate these homes and the people who live in them before placement of an innocent child? Who place children in homes where violent criminals live? Where children are exposed to much more danger than in their own homes? Were the Supervisor's in these cases demoted, fired or held accountable?

Or maybe all of these offenses were perpetrated by Tracey Gubbins. She seem's to be in on everything unethical in the Nashua Office. Were all of these people really following her order's? Is she also responsible for parent's not being given Family Rights booklet's? Why wasn't she demoted or fired?

I'm sure there are many more Nashua Supervisor's guilty of these offenses along with much worse offenses. After all, isn't NH known as the Child Snatcher State? So why was Tracy Roukey singled out? For that matter, why is the Nashua Office still open? And why is the crude Maggie Bishop still the Director?

Here's a modest proposal: Let's dose up kids stuck in low-income schools with Adderall, even if they don't have A.D.H.D, to compensate for the advantages enjoyed by kids in richer schools. That's what Dr. Michael Anderson, an Atlanta pediatrician who calls himself a "social justice thinker" has started doing, reports The New York Times's  Alan Schwartz. "I don’t have a whole lot of choice," Dr. Anderson told Schwartz. "We’ve decided as a society that it’s too expensive to modify the kid’s environment. So we have to modify the kid," he said. Schwartz notes that he isn't sure if Anderson is part of a "wider trend," but cites "some experts" who say the drug is being used in low-income elementary schools on kids whose parents want them to have better performance. And from the sounds of it, Schwartz isn't alone. "We as a society have been unwilling to invest in very effective nonpharmaceutical interventions for these children and their families," Dr. Ramesh Raghavan, a child mental-health services researcher at Washington University in St. Louis told Schwartz. "We are effectively forcing local community psychiatrists to use the only tool at their disposal, which is psychotropic medications."
