As is discussed in the previous post to this Blog, when I read the guidance issued by the Administration on Children Youth and Families (ACYF) concerning the kinds of proposals they want to see for child welfare waivers, I was worried.

Now that I’ve heard ACYF Commissioner Bryan Samuels give a presentation about this guidance, I’m even more worried.

I  want to wish a happy Father’s Day to all those dad’s who are struggling to see their children and have not given up. When there are allegations of child abuse, the family court judges are in a no-win situation. If an allegation is made, usually the court will opt on the side of protecting the child until a thorough investigation is complete.

Justices hope the threat of litigation will deter mothers from lying about the identity of the father. (And what about CPS/DCYF and the Judges who commit this same fraud?)

Note: So wouldn't that also mean CPS/DCYF and Family Court Judges can also be charged for Paternity Fraud when they terminate the rights of Fictitious Father's? A practice well known in New Hampshire Court's!

IOWA CITY -- A mother who falsely represents the identity of the father of her child can be sued for fraud and ordered to pay back financial support she received, the Iowa Supreme Court ruled Friday.

The court reluctantly opened the door to claims of paternity fraud, a controversial and particularly messy area of litigation that had not been recognized in Iowa. Chief Justice Mark Cady warned litigants to use caution in bringing such cases, saying they would be hard to prove, emotional and embarrassing.
