This is a list of question's for The NH Supreme Court and Judge Edwin Kelly.
I have no knowledge of whether they ever received them as they were NEVER answered.

Questions For The New Hampshire Supreme Court AND Judge Kelly

1.       Is it legal to rule on “Hearsay” in Family Court without proof?
2.       Is it legal for a Judge to let “Hearsay” keep a child from innocent family members, slandered
by DCYF?
3.      When a proven false report keeps a child from innocent family members, once the Judge realizes it was a false report, why is the family still denied placement of the child?
4.      When a proven false report keeps a child from his/her parents, once the Judge realizes it was a false report, why is the parent still deniedthe return of the child?
5.      Why are people who make false reports to DCYF NOT prosecuted?
6.      Why are children being allowed to be taken illegally from their families and placed in foster care and never returned?
7.      Why doesn't the Judge enforce that all family be located for the child placement before the child is placed into foster care?
8.      Why doesn’t the Judge ensure that there is continuity of family visits prior to termination of parental rights?
9.      Why doesn’t the New Hampshire Courts enforce the Indian Child Welfare Act?
10.  Will the courts hold DCYF accountable for failing to abide by the Indian Child Welfare Act?
11.  Why does the court allow a child to be placed in a foster home which doesn’t meet New Hampshire Foster parent “Residence Requirement’s”?
12.  Why does the court allow children in New Hampshire to be adopted into homes of fosters whose homes are too small for ALL theadults and foster children?
13.  Aren’t background checks and fingerprinting supposed to be done on every household member over the age of eighteen?
14.  Do the courts keep track of these adopted children?
15.  Is it legal for a Judge to deny the right of the accused to remove court-appointed Counsel?
16.  Is it legal to deny the accused the right to the court CD’s from the accused hearings, which prove perjury by DCYF and others?
17.  Is it legal to deny the accused the admittance of evidence which proves innocence, which the Judge neglected to order at the onset of a case?
18.  Is it legal for the Lawyer of his client to neglect to subpoena witnesses to testify in her behalf, even after being given a list of favorable witnesses?
19.  Is it legal for the Lawyer of the client to refuse to file motions and appeals requested by the client?
20.  Is it legal for the Lawyer to refuse his client’s request to look through her file?
21.  Is it legal for the Lawyer to refuse his client copies of her file, stating it would cost too much?
22.  Is it ethical for a Lawyer to call his recovering client a “Junkie”, more than once?
23.  Isn’t it the duty of the clients Lawyer to let her know what files he has and what files he never received?
24.  Is it ethical for the Lawyer to tell his client he has more important clients than she is?
25.  Is it ethical for the court-appointed Lawyer to tell his client how much money he makes working on her case?
26.  Is it ethical for the clients Lawyer to tell the client he didn’t fight because the state doesn’t pay him enough and the court is his boss?
27.  When a parent’s Lawyer refuses to file a motion and she in turn files it herself and receives a court date, but is in a program and is NOT allowed to leave for the hearing and the Lawyer is told in advance by the Director of the program that she can’t attend the hearing, he is requested to postpone the hearing, but neglects to do so, Judge Bamberger automatically rules against the parent, “With Prejudice”, why does it go against the parent?
28.  Isn't it bias for Judge Bamberger or any Judge to hear a criminal and a guardianship case for the same parent/child at the same time?
29.  When a person has a child custody case and has been arrested on a criminal charge from 4 months earlier, and is under medical care and waives her probable cause hearing in order to get her bail lowered, does it not show bias by Judge Bamberger when he opts to keep her in jail three more weeks before being bailed out, in which she definitely would have died in that time?
30.  Do the New Hampshire Courts have the authority over Valley St. jail when needed medication, even brought to the Medical Dept. by a family member, are denied an inmate?
31.  Is a Judges bias worth the death of another Valley St. inmate?
32.  Do Judges normally make a parent of a child arrested get on the stand and testify as to where bail money came from, as in this case?
33.  Is it ethical or legal for the Judge to state, “It doesn’t matter if your child was taken illegally. It’s too late. You had thirty days to file an appeal?” The appeal her court-appointed Lawyer refused to file.
34.  Is it ethical or legal for Judge Tenney to court order a mother out of Methadone treatment in order to regain custody of her child?
35.  Isn’t court ordering anyone out of treatment discriminatory and illegal?
36.  Is it ethical or legal for Judge Tenney to court order a mother into a non-existent medical methadone detox program?
37.  When a parent is court ordered into a program that doesn’t exist, is it legal to terminate her rights for non-compliance?
38.  Aren’t Judges supposed to read through a persons file before making a judgment, or are they just supposed to take the word of DCYF?
39.  Is it legal in New Hampshire for government workers to commit perjury?
40.  When DCYF stands up and tells the Judge the parent is in non-compliance, isn’t the Judge supposed to be given proof of non-compliance, or does he just rule on DCYF’s say so?
41.  Is it ethical or legal for Judge Patten to deny ever receiving an affidavit of paternity when the affidavit is included in an objection brief from the Attorney Generals Office and then four days later, the Judge grants the adoption of a child whose fathers rights were NEVER terminated?
42.  Is it the norm in New Hampshire for fictitious father’s rights to be terminated and the REAL father’s NEVER contacted?
43.  Is it ethical or legal to deny the REAL father of a child the right to paternity testing and the right to challenge the adoption of his child?
44.  Is it legal for a Judge to grant adoption when an appeal is pending?
45.  Is it ethical or legal for Judge Cloutier to state the opposite of testimony and evidence in his decision, which was admitted at a Termination of Parental Rights Hearing and subsequently terminate the parents rights due to his own false statements?
46.  Is it ethical or legal for a Judge to deny new cutoff rates for alcohol and drug consumption in deciding a Termination of Parental Rights case?
47.  Is it ethical or legal for a Judge to rule against the parent’s wishes when the foster parents ask to take the foster child out of state and theJudge subsequently tells the parent he doesn’t care what she wants, he’ll let them take the child any way?
48.  Is it legal for parents and friends to be denied the right of admittance into family court as requested by the accused parent, even though new laws went into effect which state family and friends will be admitted?
49.  Why do the Judges allow DCYF to overrule them?
50.  Is it ethical or legal for the Judges to only listen to DCYF and to kowtow to everything they want?
51.  What does the Judge do to ensure the well being of the child in DCYF custody?
52.  Why aren’t parents allowed to testify?
53.  Why aren’t family members allowed to testify in many cases?
54.  Is it legal when a grandparent files a petition for custody or visitation and is told to be in court for a review hearing and then is denied theright to go into the courtroom to be heard and the clerk comes out and tells her she’s denied?
55.  Why is a parent ALWAYS presumed guilty in New Hampshire, even when they have proven their innocence?
56.  Why doesn’t  the Judge ensure that the constitutional rights of the family are upheld prior to termination of parental rights?
57.  When a parent proves innocence, why are their rights still terminated?
58.  Is it true every parents rights are terminated at TPR in New Hampshire and the Supreme Court NEVER reverses Parental Rights Terminations, as stated by a former DCYF worker?
59.  Is this the reason Lawyers always tell parents there is no chance of winning a TPR?
60.  Why does the court hold TPR’s when every parent loses any way? When evidence of innocence means nothing? When the parent is treated worse than a convicted criminal?
61.  Isn’t it true adoptions can be reversed due to fraud?
62.  Are there any cases in New Hampshire where the adoptions have been reversed?
63.  Are there any cases in New Hampshire where a TPR has been reversed?
64.  Why are parents not being allowed “Due Process” in New Hampshire Courts?
65.  Why are New Hampshire families Constitutional rights violated every day in New Hampshire Family Courts?
66.  Why aren’t Judges being held accountable for their errors?
67.  Why aren’t unethical Lawyers held accountable?
68.  Why are “Secret” Family Court’s still being held in New Hampshire?
69.  Is it to make sure no-one knows of the pain and suffering bestowed upon children and families needlessly and fraudulently, be the parents guilty or innocent?

71.  Why are parents only given thirty days to produce new evidence, yet a convicted criminal can at any time admit new evidence and his sentence is overturned?
72.  Why are parents only allowed thirty days to appeal after the Adjudicatory hearing?
73.  Why are parents treated with such disdain by the New Hampshire Courts?
74.  Why are families being needlessly torn apart by the New Hampshire Courts?
75.  Why aren’t foster children allowed placement with family members?
76.  Why aren’t adopted children allowed contact with family members, especially family members with whom they share a strong bond with?
77.  Why do the New Hampshire Courts allow the traumatization of New Hampshire children?
78.  Why doesn’t the New Hampshire Courts hold DCYF accountable for their deceitful   practices and abuse of families?
79.  Why are family members allowed to be slandered, without proof of any wrongdoing, with no recourse and NEVER allowed to be heard?
80.  Why are children allowed to be removed from a home without court order or warrant?
81.  Why aren’t grandparents allowed a hearing before the child is removed from their home?
82.  Why are grandparents told they have no standing when fighting for their grandchildren, when the grandchildren would never have been born if not for the grandparent having children to begin with?
83.  Why do grandparents have no rights in New Hampshire according to the courts?
84.  When parents appeal a decision of the Probate Court to the Supreme Court and show proof of errors made by the Judge, why isn’t the decision overturned? Do the Supreme Court Judges read through the court transcript and go through all the evidence? How is it the decision is NOT overturned?
85.  What is the court going to do knowing that DCYF is not following their own policies and mission statement?
86.  Is the court going to do anything about the children who were illegally adopted?

These are the question's NH DCYF Maggie Bishop refuses to answer for the Redress Grievance Committee. Attorney General Michael Delaney also told Maggie Bishop NOT to answer them, due to confidentiality.
Do you see any names pertaining to these question's? I don't. Yes, these question's do pertain to DCYF cases. Cases of parent's and family member's railroaded by NH DCYF and the Family Court, but there are NO names, which has no bearing on confidentiality.
Maggie Bishop know's that if she answer's these question's, the Redress Committee will then ask WHY DCYF's Practices and Protocol's were NOT followed. Either way she loses!

1. Having requested a toxicology report does any DCYF policy/protocol/rule or
circumstance allow an investigation of a report of abuse and neglect due to drug exposure
to go forward before the report is in hand?
2. What DCYF policy/rule/protocol or circumstance gives DCYF the right to remove a child
from a parent for drugs in the newborn that were given to the mother by doctors during
labor?
3. Outline DCYF policy/protocol/rule or circumstance regarding "anticipated' neglect or
"neglect in the future?"
4. What DCYF policy/rule/protocol or circumstance allows DCYF to charge a parent with
abuse and neglect before the mother was ever allowed to take the newborn home from the
hospital?
5. What DCYF rule/policy/protocol or circumstance allows a DCYF worker to represent a
proven false report as true to a Judge without any evidence substantiating the report?
6. Under what DCYF rule/policy/protocol or circumstance is a DCYF Lawyer allowed to
order a relative to take back a complaint made to the Attorney Discipline Office?
7. Under what DCYF rule/policy/protocol or circumstance does it state slandering parents
and family members is allowed in order to place a child in foster care?
8. Does DCYF have exemptions from the Federal mandates a) requiring them to seek
relatives for placement of a child before the child is placed in foster care? b) requiring
services are to be provided before a child is removed from the parent?
9. Define "imminent danger."
10. How does DCYF determine if a child is in "imminent danger" before being removed
from the parent?
11. Does DCYF policy state "Neglect in the Future" is considered to be imminent danger and
under what policy?
12. Is there ever a circumstance where DCYF may ignore Federal Title IV (or 42 USC)
Laws?
13. What DCYF rule/policy/protocol or circumstance allows DCYF to refuse placement of a
child taken into custody by a fit and willing relative requesting placement?
14. When can DCYF tell relatives, "Relative placement is NOT an option?"
15. Describe the investigation that must take place by DCYF before a child is removed from
the parent?
16. Is there ever a circumstance where a full investigation of the parent and family where a
child will live might not take place?
17. Under DCYF rule/policy/protocol or circumstance when an assessment worker admits in
court she didn't do a thorough investigation and significant facts were overlooked should
the charges against the parent be dropped due to that negligence by the assessment
worker?
18. Does DCYF rule/policy/protocol or circumstance require the DCYF Assessment worker
study the medical files of a new mother so she knows a) what complications the mother
may have suffered during pregnancy; b) if a mother's pregnancy was labeled "High
Risk", and; c)what drugs were given in labor?
19. Does the Assessment worker have the right to a) falsely state in her affidavit that the
mothers labor was induced due to complications, when it wasn't induced at all: b) to try to
coerce a parent into signing an application for Title IV-B funding or sign it herself when
the parent is ineligible and therefore refuses to sign.
2 0 . Does any worker have a right or are there rules or expressed protocols preventing
coercion of a parent into signing a Case plan by telling the parent if she doesn't sign she
will never see her child again?
2 1 . When may a parent not be included in the making of a case plan?
2 2 . Under what circumstances does DCYF have the power or right to order a parent out of a
methadone treatment?
2 3 . Is it possible for the testing of a strand of hair from a parent to come up clean but a urine
specimen taken at the same time to show a significantly different result?
2 4 . Is there a DCYF rule/policy/protocol or some circumstance that ever allows a worker to
make a parent stick a dirty swab which fell on the floor in her mouth for a drug test?
2 5 . Do DCYF rule/policy/protocol or any circumstance ever allow a drug test to go forward
when the urine specimen is not the required amount?
2 6 . What DCYF rule/policy/protocol or circumstance gives DCYF the right to
ever barge into a parents home without a warrant?
2 7 . Under what exceptions would a parent not be given Family Rights booklet at the onset of
a case? Describe DCYF responsibility to do so and a parent's recourse when that is not
done.
2 8 . What DCYF rule/policy/protocol or circumstance limits friends or family members from
being in the room when a parent accused of abuse and neglect is being questioned?
2 9 . Describe in detail the limits of any DCYF rule/policy/protocol or circumstances where the
parent may be denied the right to live at home with her parents when she is unwell?
3 0 . Under what circumstances may DCYF leave a child in the care of a mother for an
additional week after declaring the child to be in imminent danger if left alone with her?
3 1 . What DCYF rule/policy/protocol or circumstance allows DCYF to place a child in a
foster home which does not meet New Hampshire foster parent residence requirements?
3 2 . Under what circumstances may DCYF a) recommend medical detox programs to the
court for a parent that don't exist in this state or, b) refuse the parent's admission into a
neighboring state's medical detox program?
33. How might it happen that a DCYF caseworker would guarantee to set up placement into a
Medical Detox program that doesn't exist and for which there is no such facility thus
making it impossible for the parent to comply?
3 4 . Under what DCYF policy /protocol/rule or circumstance is a caseworker allowed to
commit perjury in court to stop a parent from regaining custody of her child?
15. Under DCYF  state; law Hn DCYF caseworkers have immunity when they commit perjury?
3 6 . Does any DCYF policy/protocol/rule or circumstance allow a caseworker to refuse a
parent admittance into a Medical Detox program in a neighboring state?
3 7 . Why would a DCYF caseworker order a mother not to tell anyone her child is half
Spanish?
3 8 . Please provide copies of the rules governing DCYF's racial placement policies?
3 9 . Provide a list of the services DCYF will provide to parents of children, and children in
their custody?
4 0 . Under what DCYF policy may a parent be punished when a visit is not had because the
parent-aide failed to show up?
4 1 . How does DCYF protect the rights of a parent who attends a medical visit for her child,
only to discover the foster parent's have either changed the appointment or simply not
shown up without notifying the mother?
4 2 . Under what DCYF policy/rule/protocol or circumstance may the non-attendence at a
child's medical appointment go against a parent who was not notified of such
appointment?
4 3 . Does DCYF policy state,  there is a time when a parent whose rights have not been terminated
loses the right to be contacted when their child is in foster care and hospitalized?
4 4 . Describe DCYF policy regarding visits between a parent and child on
birthdays, Christmas and other holidays? Describe kind of parent (Bio or Foster)
4 5 . Under what circumstances may DCYF deny a mother the right to have her child baptized
while in foster care?
4 6 . Describe what DCYF policy/protocol/rules or circumstances that disallow a parent
visitation with her child when in jail?
4 7 . Does any DCYF policy, rule or protocol allow a DCYF caseworker to tell a mother in jail
that she will bring her child for visits if it isn 't behind glass???, only to have the mother
plead guilty and sentenced to prison in order to see her child?
4 8 . Does DCYF policy tolerate workers who declare publicly that a parent's rights will be
terminated not even halfway through a case?
4 9 . A caseworker is reported to have stated that, "Every parent loses their Termination of
Parental Rights hearing's in New Hampshire; children are never returned in New
Hampshire, and; the New Hampshire Supreme Court Never reverses a parental rights
termination." Please respond with data related to these issues.
50. How would DCYF discipline a worker who knowingly used a fictitious name for a child's
father, when the father's name was in the files?
51. What is DCYF policy regarding notification of a child's father before adoption of his
child?
5 2 . What would DCYF do if their lawyer filed an affidavit with the Probate Court falsely
claiming that the grandparents failed to disclose in their Petition for Guardianship that the
child was in DCYF custody?
53. What would DCYF do a) if they were convinced that a parent-aide had denied a mother
the use of special baby bottle supplied by the fosters even though it was in her (the aide's)
possession at the visitation and even though she knew the baby would not eat from a
regular bottle and subsequently denied the baby a feeding for five hours, and; b)what
would they do with a complaint by the mother?
54. Describe in detail what DCYF thinks of as "Reasonable Efforts" to facilitate Reunification?
55. How does DCYF help its employees to rethink their attitudes toward a parent accused of
abuse and neglect even after being proven innocent?
56. What DCYF policy gives DCYF the right to tell a parent if they don't agree with a
recommendation, the caseworker will have the Judge court order it?
57. When does DCYF have more authority than a judge and why would anyone at DCYF
state that a judge has no say  on whether a child will ever be returned - that it 's up
to the caseworker?
58. Why and when might a DCYF Lawyer say to a citizen of New Hampshire that the Judge
has no say as to placement of a child or that such placement is up to the DCYF Lawyer?
59. Describe guidelines for notification of the Indian Counsel when a child with Indian
ethnicity or heritage is placed in foster care and under what circumstances may they be
ignored?
60. What are DCYF procedures for investigating and determining a child's heritage, ethnicity
and culture
61. Describe DCYF policy/rules/procedures regarding placement in a foster home which
practices a different religion than the child's family?
62. Describe DCYF policy/procedure/rules etc. concerning Family Preservation?
63. Does the Federal government funding for children placed in foster care and adopted out
discourage family preservation?
