Offer of proof-When your Evidence is Denied


Offer of proof - Wikipedia, the free encyclopedia:

An offer of proof is a kind of motion that a lawyer may present to a judge or to the official presiding over an administrative hearing.
In the context of a trial or a hearing, a presiding judge may issue a ruling denying a party the right to proffer evidence. The party aggrieved by this ruling then has the right to indicate for the record what the evidence would have shown had the adverse ruling not been issued. This is necessary in order to preserve the issue for appeal.[1][2]
In jury trials, offers of proof may be made outside the hearing of the jury. A party may request a motion in limine (Latin: "at the threshold") made before the start of a trial requesting that the judge rule that certain evidence may, or may not, be introduced to the jury in a trial. In some cases this may be made at the bench (with the court reporter taking down every word spoken by the parties and the judge) or the jury may be excused. It is common for the jury to be excused and for a party to be allowed to continue questioning a witness outside the hearing of the jury until the judge can determine if the evidence sought is relevant and not otherwise excludable.

California Governor Jerry Brown recently signed SB 48 into law and it goes into effect on January 1, 2012.
SB 48 mandates positive teaching of lesbian, gay, bisexual and transgender lifestyles to children of ALL ages. That means that any child attending public school starting with kindergarten on, in the state of California will be indoctrinated to accept lifestyles that God refers to as being an ‘abomination’ and punishable by death; Lev. 20:13 (God’s words, not mine).

Comment: It's too late to worry about the New Hampshire citizens trust and confidence. It was gone a long time ago thank's to DHHS/DCYF and the Family Court's and there's no need to look at the Legislature to come up with the money to pay off this lawsuit. DCYF and the court's will just take more children from innocent parents railroaded by the system, place them in foster care and adopt them out and our Federal Government will reward them with more federal funding, believing all the while that DCYF is following federal mandates. NOT!

The state must pay $3.55 million to seven residential care providers to resolve a lengthy billing dispute over caring for children, the state Supreme Court ordered this week.

In its 12-page decision, the court wrote that “the functionality of state institutions depends on the trust and confidence of New Hampshire citizens. Allowing the State to disregard its contractural obligations would undermine this trust.”
