A mother defendant below has a civil suit against the state of NH 226-2010-CV-00612, Nashua Superior Court South.

On 1/5/11 while driving down Broad Street in Nashua, NH she is stopped after sitting at a red light turning onto Bluehill Ave at 2:20 am, allegedly for speeding on Board Street. Witnesses’ confirm the police only came up behind her at the red light with no flashing lights. The mother relays the office stated, “Do you know why you are being stopped?” To which, she replied, “No, the light was green.” The officer stated, “You were speeding.” And she asked, “Where? I got every red light.” He then answered, “On Broad Street.” She inquired of the officer why hadn’t he stopped her sooner. He said that he didn’t want to stop her on the bridge. She asked him to tell her how fast she was going. He replied that he had clocked her. She simply asked, “Where? You just got behind me coming from the 96 Broad street gas station 500 yards away.”



For the 1st hearing CASE No. 459-2011-CR-01499, the officer did not show up on 4/25/11; the Defendant relayed to prosecutor Giggi that she was not speeding and was stopped at Bluehill Ave and not Broad Street as stated on the ticket. The Prosecutor stated that the officer’s notes indicated she was speeding as of Dublin Street a mile away and that Bluehill Ave. was off Board Street. Our question is if she was speeding, why didn’t he stop her sooner and why did witnesses state the officer hadn’t appeared until more than three quarters of a mile from where he stated she came in from? Did he eyeball and guesstimate it?? Seriously…

Had the proceeding been able to proceed without conflict due to the presiding Justice Bamberger, it would have been dismissed because the officer was not present to be cross-examined on 4/25/11.
Furthermore, on 4/25/11 the court issued a new notice for a hearing on June 3, 2011 at 8:15 AM located in the Juvenile Hearing Room as requested by Officer /Prosecutor Giggi.

Here's the oddity in this case, Prosecutor Giggi had the court set up another date for a hearing. The peculiarity of which is that it is scheduled in a non-public court room, specifically the Juvenile Hearing Room of the NASHUA District Court on 6/3/11 at 8:15 am. This is the same date the woman has a hearing in the criminal portion of the civil suit in Merrimack Family Court.

But of most concern, a public matter “a traffic ticket” is now going to be heard in a closed door court, the Juvenile Hearing Room is an inappropriate venue for a hearing on a traffic ticket and seeks to preclude public access and should be changed to an appropriate public court if the motion to dismiss is not granted. The Defendant also had to request the recusal of Judge Bamberger and Judge Leary due to their conflict in the civil matter above.

Typical of Nashua, New Hampshire Police stuck in the intimidation pose, a sign of guilt. Only time will tell and still waiting for a response in the Civil Matter for over a month. The Criminal matter which should have been heard within 30 days will finally be heard after 69 days in the Merrimack Family Court which is open to the public on June 3, 2011 at 11:30am. A copy of the criminal matter which parallels the civil matter will be out here shortly. The civil matter is of course trying to be kept private by the Division of Health and Human Services, however it will be public record once it hits the 1st circuit and we will have links for you right here.

Sometimes the truth IS a revolutionary act.

What sense does it make to have trial's to terminate a parent's right's when the outcome is already planned by CPS/DCYF and the court's?
My younger daughter's right's were terminated to her newborn daughter even after her innocence was proven in Nashua, NH District Court. A TPR hearing followed in Hillsborough County Probate Court in Nashua, NH where Judge Cloutier presided.
My daughter's Lawyer for the TPR stated from the very beginning she would lose and her right's WOULD be terminated. He tried to talk her into mediation. We already were well aware DCYF does NOT keep their word. We knew mediation was a farce. That any deal DCYF and the court made as to mediation, would NOT be honored.
Her case wrecker Kris Geno also tried to talk her into mediation. She refused. She believed there was a chance of regaining custody of her daughter. She believed if the truth came out, her daughter would be returned. We truly believed her daughter would be returned. We clearly won and were extremely happy after the trial. We knew we proved her innocence. We had no idea just how corrupt DCYF and our judical system are in NH.
The truth DID come out, but it didn't matter. Judge Cloutier stated the opposite of the testimony and proof given in court. He downright lied in his decision. Little did my daughter know, parent's don't win TPRs in NH. All a TPR is in NH is a formality to sever the right's of a parent and child forever legally, or shall I say ILLEGALLY. The truth doesn't matter. Once DCYF get's their dirty little clutches into your child, the child is lost forever. Innocent or guilty, you lose. Even a Supreme Court appeal is useless. A Judge is SUPPOSED to be ruled against when he makes error's in his decision. Judge Cloutier clearly lied and the NH Supreme Court stated he made no error's. So I guess the Supreme Court is just as corrupt as the rest. If the Judges did their job's and read the transcript's, they'd know about all the lies Judge Cloutier wrote, not that all the transcript's are on the up and up. Many of them have statement's left out, like in my daughter's case. The CASA worker stood up in Court and stated she didn't have to testify because everyone got her last report. Judge Cloutier yelled at her and stated, "You didn't give one to me." That was left out of the transcript. The CASA worker also spoke clear enough to Kris Geno that everyone in the courtroom heard her say, "Isabella HAS a Mommy and Daddy now!" That wasn't in the transcript either.
After Austin was taken from his mother, illegally AND her innocence was proven, he was placed in the children's home where they started looking for an adoptive family shortly after he was placed there. Criminal charges against my daughter were dropped, yet the CPSW Anna Salvatore and the CASA worker vowed to make sure he was never returned and Judge LeFrancois refused to drop the DCYF charges and return her son.
My daughter's caseworker told me my daughter's right's WOULD be terminated. I said, Don't you mean IF they are terminated?" She said, "No, when they are terminated." I said "How do you know they will be? Is it already planned in advance?" I didn't get an answer.
Now I know why one of the caseworker's told my husband and I,"Nobody get's their kid's back in NH. Every parent loses their TPR. The NH Supreme Court NEVER reverses a TPR and DCYF can do whatever they want because our government gave them the power to do so."
So why is our state wasting money on TPR's when they mean absolutely nothing? Do the Judges get a big payoff for every parent's right's they terminate as well as DCYF? Our Judicial system is crying they have no money, yet they let DCYF pull their string's and go along with ALL the lies of DCYF. Money mean's more to ALL of them than the best interest's of a child. If they stopped stealing children from innocent parent's and did something to help the truly abused children of NH, they wouldn't be crying NO MONEY! What are they doing with all the federal funding they get for every stolen child? Oh, that's right, the state is using ALL that money elsewhere. None of the money is going on services to preserve families. Just check out the NH government website. Governor Lynch's Transparency Report tell's it all!
