Court revives child death case involving DCS - WHNT
KNOXVILLE, Tenn. (AP) — The parents of a 6-month-old Johnson City boy who died while being monitored by state social workers are getting another shot at making a wrongful death claim against the state of Tennessee.
The Tennessee Court of Appeals said this week there is a real question about whether the state Department of Children's Services could have foreseen the 2004 death of the child.
The infant, Demetrius Tyler, drowned the day after his DCS-approved caregiver was arrested for leaving him and two other children unattended.
It's not clear whether the state will appeal the decision.
In court documents, the parents claim they told a DCS social worker that the woman had been arrested but the agency did nothing.
The case now goes back to the Claims Commission.

DEARBORN, Mich. -- A Michigan family has filed a lawsuit more than 20 years after the state removed four of their children from their home.
In 1985, Rehab Amer was accused of killing her 2-year-old son Samier. But it was later confirmed that the toddler had brittle bone disease and died from injuries he received during a fall. The mother was acquitted of a negligent homicide charge but said her three other children were still removed from the home and put in foster care. A fourth was later taken a day after its birth.

With a lawsuit, congressional efforts and a stinging new report, critics of current foster-care policies are accusing child welfare agencies of unfairly confiscating foster youths’ government benefits and undermining their prospects when they age out of the system.
At the heart of the controversy is a practice common nationwide — state agencies taking control of Social Security benefits that are earmarked for foster children with disabilities or a deceased or disabled parent.

"We've said all along that this issue is about child welfare," said Family Council Action Committee President Jerry Cox. "We are confident that the Arkansas Supreme Court will rule in favor of keeping Act 1 part of Arkansas law."
In 2008, Arkansas voters passed Act 1-a law that prevents foster or adoptive children from being place in cohabiting homes-by 57-percent of the vote.
