The juveniles escaped out a window from the one-story facility.

The lack of transparency conceals the second problem with the Court of Protection, which in the same way as much of Family Law relies upon the opinions of individual experts. The opinion of a single social worker that someone does not have the capacity to decide where they live is sufficient for someone to lose their freedom, in secret and without the right to a second opinion.
This problem of process and the appointment of the Official Solicitor as a litigation friend is not limited to the Family Division.

This bill changes the authority for recommending marital masters for appointment and reappointment from the administrative judge of the judicial branch family division to the supreme court or its designee.

The bill also requires marital masters to be reappointed for 5-year terms in the same manner in which they were appointed.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT relative to appointments and reappointments of marital masters.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Reappointments of Marital Masters. Amend RSA 490-D:7 to read as follows:

490-D:7 Nominations and Appointments of Marital Masters.

I. The [administrative judge of the judicial branch family division, with the concurrence of the] supreme court or its designee, shall recommend persons to the governor and council for [initial] appointment and reappointment as marital masters. In recommending candidates for [initial] appointment and reappointment as marital masters under this chapter, the [division] court or designee shall utilize the procedures and standards described in the rules of the judicial branch family division, except as otherwise provided in this chapter.

II. For appointments of new marital masters, [the administrative judge of the judicial branch family division, with the concurrence of] the supreme court[,] or its designee shall submit to the governor the name of a nominee. The governor may accept the candidate nominated by the [administrative judge] court and submit the candidate to the council for confirmation or may reject the candidate [submitted by the administrative judge,] and request a new nominee. If the council rejects a candidate for confirmation, the governor shall request a new nominee.

III. Marital masters shall serve an initial term of 3 years. Subsequent reappointments shall be for 5-year terms and shall be made in accordance with [judicial branch family division rules] the procedures for appointment of new marital masters established in paragraphs I and II. During appointment terms, the authority and responsibility to conduct annual performance reviews, and termination, if necessary, shall be with the [administrative judge of the judicial branch family division] supreme court or designee.

2 Applicability. Section 1 of this act shall apply to all marital masters appointed or reappointed on or after January 1, 2012.

3 Effective Date. This act shall take effect January 1, 2012.

STATE OF NEW HAMPSHIRE

AN ACT requiring a performance audit of the guardian ad litem board and guardian ad litem services.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Performance Audit of the Guardian Ad Litem Board and Guardian Ad Litem Services.

I. In addition to any other performance audit requirements, the audit division of the legislative budget assistant shall complete a performance audit of the guardian ad litem board and guardian ad litem services. The audit and the resulting report shall be completed no later than November 1, 2011, and shall include an assessment of:

(a) Governance and board membership.

(b) The application, certification, and preservice and continuing education requirements for guardians ad litem.

(c) The adequacy and appropriateness of the existing fee structure.

(d) The adequacy of program monitoring and oversight mechanisms, including complaint resolution procedures and associated fees.

(e) Education and training requirements, including the scope and comprehensiveness of training in family dynamics, child and adolescent development, preparing evidence/fact based reports for the courts, criteria for and process by which families are referred for clinical and other services, and any other matters as may pertain to improving the quality of services.

(f) The role of the supreme court in regulating the certification, qualifications, training, standards, oversight, and decertification of guardians ad litem.

II. The legislative budget assistant shall submit the final report of the performance audit to both the joint legislative performance audit and oversight committee and to the fiscal committee of the general court, for transmission to the governor, the speaker of the house of representatives, and the president of the senate.

2 Effective Date. This act shall take effect 60 days after its passage.

STATE OF NEW HAMPSHIRE

AN ACT establishing a committee to study the guardian ad litem board.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Committee Established. There is established a committee to study the guardian ad litem board.

2 Membership and Compensation.

I. The members of the committee shall be as follows:

(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.

(b) Two members of the senate, appointed by the president of the senate.

II. Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

3 Duties. The committee shall study the membership, duties, and organizational structure of the guardian ad litem board, established in RSA 490-C. The committee may solicit information and testimony from individuals and entities with expertise or experience relevant to the study.

4 Chairperson; Quorum. The members of the study committee shall elect a chairperson from among the members. The first meeting of the committee shall be called by the first-named house member. The first meeting of the committee shall be held within 45 days of the effective date of this section. Three members of the committee shall constitute a quorum.

5 Report. The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2011.

6 Effective Date. This act shall take effect upon its passage.
