NCCPR Child Welfare Blog: Shedding light on foster care abuses: "A new law review article provides more evidence that “sunshine is good for children”
In a 2009 post to this Blog, I wrote about how a tiny newspaper in a small town in Tennessee exposed an injustice:
In 2005, the Lebanon (Tenn.) Democrat, revealed that, at least twice, a local judge ordered Mexican mothers to learn English – or lose their children forever. (Access to the story may require free registration on the newspaper's website.) In one case the child still lived with the mother, in the other the child was in foster care. In both cases, the mothers spoke an indigenous language rather than Spanish."
Exposing Child UN-Protective Services and the Deceitful Practices They Use to Rip Families Apart/Where Relative Placement is NOT an Option, as Stated by a DCYF Supervisor
Unbiased Reporting
What I post on this Blog does not mean I agree with the articles or disagree. I call it Unbiased Reporting!

Model how equity and attention to racial disparities can be built into community engagement and policy development processes.
Identify a few key areas for further exploration during calendar year 2011.

FIGHTING THE KANSAS CHILD ABUSERS
FIGHTING THE KANSAS CHILD ABUSERS
by Bill Medvecky on Thursday, February 3, 2011 at 2:26pm
Kansas is one of the biggest CPS and CASA sewers in the Country. If you can be there or help, they are begging:
Just found out that the children's issues committee on foster care which involvesinvolvess the private contractors and SRS will be meeting on Thursday, February 10, 2011, and Tuesday, February 15, 2011, at 9:00 a.m., at the Topeka Capitol in room 142 south.
If any of you are able to attend either of these meetings or both, please come as we do need to show what an epidemic the srs and private contractor conspiracy and that they are taking children from families and are not practicing family preservation which is required by state and federal laws.
Rep Mike Kiegerl is the chairman of this committee and his e-mail is jus4smk@aol.com; if you would like to contact him. we had been under the impression that since these families have sent their stories to him that there will be no families allowed to speak, even though we had been told in the past that families would be allowed to speak. however, private contractors and SRS will be allowed to speak and try to convince the committee that they are doing a great job....yeah, right!!! (Someone please tell me about living in a Democracy again, I forgot.)
None the less, we need people/bodies there, as many as we can because we will still be contacting legislators in their offices and in the hallway telling them of what is really going on in the "SRS system". Also, we need to show that all families are supporting each other and are experiencing the same illegal targeting and conspiracies by SRS and the private contractors.
please come if you can. we can even carpool. please contact me if you will need to carpool or if you have any questions. you might want to e-mail mike kiegerl and ask him why the agenda for the committee has changed since we all have been told for 3 years that families can testify and that the committee would move toward eliminating private contractors who only take and keep children (sometimes forever) from their families illegally. They have no hearts or souls and we know that and we need to show this to the legislators.
please try to come. thank you so much. this may be the last time for anything of this type for many, many years. "They" cannot shut us up....we will get our children and grandchildren some day....Stay strong....God is on our side!!!!!!!!!!!!!!!!
I just sent in my appeal for the dismissal of my federal lawsuit after 9 months of fighting the "system", but i am appealing and will never give up until my last breath!!! Are you with me??
I have also talked with Mike Kiegerl about have a "citizens review committee" who will have the power to review these past cases and complaints and maybe even these families will be able to get their children and grandchildren back. This citizens review committee is allowed by Kansas state law. Kiegerl told me to look up this law that permits this and submitt it to the Lt. Governor. This is what i plan to do and if any of you would like to help, please contact me. i can use all the help i can get. we are all in this together and what helps even one family will ultimately help us all.
thank you!!!

Phillip Garrido ruled competent to stand trial in Jaycee Lee Dugard kidnapping
Phillip Garrido ruled competent to stand trial in Jaycee Lee Dugard kidnapping | L.A. NOW | Los Angeles Times
The judge in the Jaycee Lee Dugard kidnapping case ruled Thursday that defendant Phillip Garrido is mentally competent to stand trial for her 1991 abduction.
El Dorado County Superior Court Judge Douglas Phimister reviewed reports from psychiatrists and handed down the ruling Thursday shortly after 1 p.m.
Garrido and his wife, Nancy, are accused of kidnapping Dugard when she was 11-years-old and holding her captive for 18 years.
The case was on hold until Thursday because of questions about Garrido’s mental competence. Lawyers for the prosecution and defense both agreed to allow the judge to decide on the issue.
Among the reports Phimister reviewed was an account from a court-appointed psychiatrist who met with Garrido to determine his mental state, said Jackie Davenport, El Dorado’s assistant court executive officer.
A preliminary hearing is scheduled Feb. 28 to decide if state prosecutors and Garrido’s defense are prepared to move forward with the case, Davenport said.
An arraignment on Garrido’s grand jury indictment is scheduled for the same day, officials said.

Federal judge says lawsuit against DHHS now class action — Health & Fitness — Bangor Daily News
BANGOR, Maine — More than 40 Maine residents with cerebral palsy, epilepsy and other related conditions will join a lawsuit seeking to force the Maine Department of Health and Human Services to provide opportunities for them to live independently outside of nursing homes.
U.S. District Judge John Woodcock on Monday granted class-action status to a lawsuit filed more than a year ago by three men with cerebral palsy who want to live on their own but retain support services.
Filed in December 2009 in U.S. District Court in Bangor, the lawsuit alleges that DHHS, in the operation of its Medicaid program, violated the Americans with Disabilities Act and the Nursing Home Reform Act because it failed to offer people with cerebral palsy, epilepsy and other related conditions opportunities to live out-side of nursing homes.
In addition, the plaintiffs have claimed that for those who do live in nursing homes, DHHS has failed to provide necessary services required under federal law.
