According to the 13th annual Department of Justice (DoJ) Health Care Fraud and Abuse Control Program report for fiscal year 2009, the federal government won or negotiated approximately $1.63 billion in judgments and settlements and U.S. attorneys' offices opened 1,014 new criminal healthcare fraud investigations involving 1,786 potential defendants.
The program--under the joint direction of the Attorney General and the secretary of the Department of Health and Human Services (HHS)--seeks to identify and prosecute the most egregious instances of healthcare fraud, to prevent future fraud or abuse, and to protect program beneficiaries, according to the DoJ.
In terms of monetary results for 2009, HHS Secretary Kathleen Sebelius and Attorney General Eric Holder certified $266.4 million in mandatory funding as necessary for the program and Congress appropriated $198 million in discretionary funding. The report stated that in addition to the settlements won, the government attained additional administrative impositions in healthcare fraud cases and proceedings.
As a result of these efforts, the Medicare Trust Fund received transfers of approximately $2.576 billion during this period from the Department of the Treasury and the Centers for Medicare & Medicaid Services, in addition to more than $441 million in federal Medicaid money similarly transferred separately to the treasury.
In the 2009 fiscal year, federal prosecutors reported 1,621 healthcare fraud criminal investigations pending, involving 2,706 potential defendants and filed criminal charges in 481 cases involving 803 defendants. In terms of enforcement actions taken during the course of the year, a total of 583 defendants were convicted for healthcare fraud-related crimes and the DoJ said that 886 new civil health care fraud investigations were opened, with 1,155 civil healthcare fraud matters pending.
“In addition to these enforcement actions, numerous audits, evaluations and other coordinated efforts yielded recoveries of overpaid funds, and prompted changes in federal healthcare programs that reduce vulnerability to frauds," according to the report.
Among the fraud noted in the report by pharmaceutical manufacturers, the largest healthcare fraud settlement in the history of the DoJ and HHS involved Pfizer, which agreed to pay $2.3 billion to resolve criminal and civil liability arising from the illegal promotion of its anti-inflammatory drug, Bextra. In addition to this company, other companies noted in the report included:
Eli Lilly entered an approximately $1.4 billion global criminal, civil and administrative settlement to resolve allegations that it illegally marketed its antipsychotic drug Zyprexa.
Bayer HealthCare agreed to pay $97.5 million plus interest to settle allegations that it paid kickbacks to several DME mail order suppliers and diabetic supply distributors to induce them to provide Bayer diabetic supplies to Medicare beneficiaries.
Abbott Laboratories agreed to pay the state of Texas and the federal government a total of $28 million in a Medicaid fraud settlement to resolve its civil liabilities related to the false pricing of certain intravenous drugs and blood products.
Kindred Healthcare and its successor PharMerica Healthcare Pharmacy agreed to pay $1.3 million to settle allegations in a qui tam complaint that Kindred billed Medicaid for a higher number of drugs than were actually administered.
Aventis Pharmaceutical, a wholly owned subsidiary of Sanofi-Aventis U.S, paid $95.5 million to resolve False Claims Act allegations that, from 1995 through 2000, it gave certain HMOs secret discounts.
Endoscopic Technologies paid $1.4 million to resolve civil qui tam allegations that it marketed its surgical ablation devices to treat atrial fibrillation, a use that is not approved by the FDA.
In addition to fraud by pharmaceutical companies, other frauds noted in the report were by physicians and other practitioners, pharmacies, hospitals, laboratories, clinics, nursing homes, mental healthcare facilities and medical equipment suppliers. The report also noted fraud in regard to kickbacks and other types of Medicare and Medicaid fraud.

WASHINGTON, May 19 /PRNewswire-USNewswire/ -- A three-part investigative series on Merck's cervical cancer vaccine, Gardasil®, highlights serious conflicts of interest across agencies of the Department of Health and Human Services (DHHS) in the development, approval and safety surveillance of vaccines. The series, by Mark Blaxill, Editor-at-Large for the Internet newspaper Age of Autism and a Director of SafeMinds, was posted on the newspaper's site on May 12-13 [www.ageofautism.com/mark_blaxill]. It preceded the announcement on May 14 that FDA, a DHHS agency, is allowing use of rotavirus vaccines despite their contamination with viral particles from pigs. Blaxill's investigation found an unprecedented vaccine "public-private partnership" between drug companies and DHHS' National Institutes of Health (NIH). NIH researchers developed key technology underpinning cervical cancer vaccines. The technology was patented and licensed to pharmaceutical giants Merck and GlaxoSmithKline through the NIH Office of Technology Transfer (OTT). When new products invented at NIH clear the regulatory hurdles at FDA and reach market, OTT shares in the profits and distributes them back to NIH and its staff inventors.
Despite clinical trials lacking a true placebo, FDA approved it for use. The CDC's vaccine advisory committee then recommended Gardasil for universal use by girls. The FDA and CDC jointly conduct the surveillance to decide whether the NIH-invented Gardasil is safe once licensed. Dr. Julie Gerberding served as the Director of the CDC when it approved Gardasil. She is now the president of Merck Vaccines. According to Blaxill, this situation creates "an unprecedented web of conflict, one in which the same departments that are tasked with regulating the health and safety of medical products are also profiting from them."
There have been hundreds of claims of injury or death from Gardasil. Some of these claims are now reaching the Court of Federal Claims, where vaccine injured petitioners are required to bring claims. Here too there are serious potential conflicts of interest as DHHS jointly administers the Vaccine Injury Compensation Program and is also the defendant against the claims of vaccine injury instead of the vaccine manufacturer Merck.
"DHHS has chosen to minimize other safety issues like mercury and viral contamination in vaccines," stated Mary Holland of CVS. "We need a stronger vaccine safety oversight agency which is independent of DHHS." CVS calls on Congress, as it has in recent letters, to hold hearings to investigate the agencies responsible for the national vaccine program. These federal agencies have failed to comply with the terms of the 1986 Vaccine Injury Compensation Act (VICA) to provide critical vaccine safety science.

I know you and your moles are quite interested in my grandparents blog and what I have to say. Therefore I know you will get my messages. You must realize by now that I will NEVER give up on my grandchildren, which I know you were the one that commandeered their illegal kidnappings and also commandeered their illegal adoption's. I'm sure you are aware that Austin's father's rights were NOT terminated and neither were Isabella's father's rights terminated. After all, you were the one in charge of terminating two fictitious mens rights! You are the one who caused Nashua DCYF to be put on the map of corrupt DCYF offices in this state.
I just thought you'd like to know I spoke to another of your former DCYF worker's. A person who admitted to me that Brenda was advocating for Austin to be placed with us. Where better could he be placed than with his grandparents who basically raised him from the day of his birth? Is money all that important to you than placing a child with the grandparents he loves more than anyone else? The grandparents he begged to be with and subsequently tried to hang himself, because you denied him the right to be with them?
I was also told that you were aware that I knew you were the person who made sure we didn't get custody of Austin. Do you feel ANY guilt at all as to the lies you wrote in our incomplete Home Study? Does it give you pleasure to count every dime you get from ALL the kidnapped children in Nashua? For all the children you have traumatized and brainwashed and put on psychiatric medication because these children fight back for their families they long to be with? Do the drugs make these children stop fighting back, so their easier to auction off? Since when is a Home Study done to show a family WHY a child can't be placed with them? We were told by the two caseworkers who met with us to do the Home Study not to worry, that Austin WOULD be placed with us. They knew Austin wanted to be with us as much as we wanted him. They knew we were the best placement option for Austin. When the Home Study was finally finished, (incomplete on the part of DCYF) ten months after it was started and we were finally given a copy and read all the lies, I knew you were the one that wrote them. Both caseworker's denied writing them. Why would they write them when they wanted Austin placed with us? You signed off. You thought you would be allowed at our meeting at the DCYF office when I specifically told Lorraine Bartlett you were NOT welcome to sit in. Well I got my way didn't I? I don't get along with liars. I consider them to be nothing but scum!
Then we were denied an Administrative Appeals Hearing. Only because the Administrative appeals unit is part of DHHS. How could anyone be treated fairly when all of you work together? The same goes for Judges and Lawyer's. They take care of their own.
Isn't it also illegal to change a child's name before he is adopted? Why did Lorraine Bartlett write this in an e-mail to the Administrative appeals unit? If the appeals unit wasn't tied in with DCYF, justice would have been served. The corruption within the Nashua office is just too big.
I hope your happy about all the trouble you've caused the Nashua office. I really thought Geraldo was going to put an end to your fraud. I believe he is a good person, but he needs to stand up to you. It's too bad your whole office has to suffer because of you! I told you I would never give up on my grandchildren. Thats a promise. Once you and your administrator are out of a job, hopefully DCYF will then be able to the job their supposed to do. To "Preserve Families." Not to rip them apart with fraud and slander! The anxiety showed on the face of 45-year-old Felix Ramirez as he waited to hear his sentence for fondling his 12-year-old foster child.
"He was supposed to protect the child," wrote prosecutor Lindsey Krause in court documents.
Instead, Ramirez admitted he snuck into the girl's bedroom late at night and molested her.

Since I cannot access my account which sends me newsletters each day, I write to you through this address,
The story you have up concerning the "Unsung heroes" of foster care, is a story that you seem to put out there about once a month concerning the Kansas foster care system.
I have to guess that you do not read the follow-up comments from your readers... This system is not only broken, it is corrupt and actually highly abusive to both the parents and children who come into contact with these businesses.
The CEO of Youthville, Shelley Duncan, earns over $200,000.00 a year. That's not a group interested in children, it's a business.
This group stops HUNDREDS of children who should, and could live with blood relatives, and yet they don't get that opportunity, because there's no money in placing children in relatives care. Federal Law DEMANDS they try to place the children with families FIRST. Yet they place these children in just 10% of the time with family? WHY?
The answer is quite simplke; If Youthville does that, who's going to pay Shelly's salary?
I don't know what the deal is between these vultures and the paper, but if you go back and do a poll of the responses from your readers, you will see that the sale is not being made. You cannot sell this turkey to the people who come into contact with them, and they keep trying to get you to understand that over and over again.
I have people ringing our phones off the hook BEGGING for help in their fight with Youthville and that corrupt D.A. you have, yet you seem to think these folks are as pure as the driven snow. Why?
Do the comments heap praise upon Youthville? Are they ALL just a pack of malcontents? Where are all the folks who think that everything in Kansas Foster care is just ducky?
THEY DON'T EXIST. If you come into contact with these people, your child is nothing more than a dollar sign. They are nothing more than job security for these ghouls.
I have a roll a dex full of people sitting in Kansas who are loosing their grandchildren, nieces and nephews and sons and daughters for nothing more than money. Want to speak to a few? How about ONE?
I ask you to go back into your own archives. Take a look at the comments on these stories and ask yourself how so many folks could be so wrong about this "Wonderful" group and the multi millions of dollars that put smiles on their faces while Kansas children pay the price, even unto death!

Sirs,
Since I cannot access my account which sends me newsletters each day, I write to you through this address,
The story you have up concerning the "Unsung heroes" of foster care, is a story that you seem to put out there about once a month concerning the Kansas foster care system.
I have to guess that you do not read the follow-up comments from your readers... This system is not only broken, it is corrupt and actually highly abusive to both the parents and children who come into contact with these businesses.
The CEO of Youthville, Shelley Duncan, earns over $200,000.00 a year. That's not a group interested in children, it's a business.
This group stops HUNDREDS of children who should, and could live with blood relatives, and yet they don't get that opportunity, because there's no money in placing children in relatives care. Federal Law DEMANDS they try to place the children with families FIRST. Yet they place these children in just 10% of the time with family? WHY?
The answer is quite simplke; If Youthville does that, who's going to pay Shelly's salary?
I don't know what the deal is between these vultures and the paper, but if you go back and do a poll of the responses from your readers, you will see that the sale is not being made. You cannot sell this turkey to the people who come into contact with them, and they keep trying to get you to understand that over and over again.
I have people ringing our phones off the hook BEGGING for help in their fight with Youthville and that corrupt D.A. you have, yet you seem to think these folks are as pure as the driven snow. Why?
Do the comments heap praise upon Youthville? Are they ALL just a pack of malcontents? Where are all the folks who think that everything in Kansas Foster care is just ducky?
THEY DON'T EXIST. If you come into contact with these people, your child is nothing more than a dollar sign. They are nothing more than job security for these ghouls.
I have a roll a dex full of people sitting in Kansas who are loosing their grandchildren, nieces and nephews and sons and daughters for nothing more than money. Want to speak to a few? How about ONE?
I ask you to go back into your own archives. Take a look at the comments on these stories and ask yourself how so many folks could be so wrong about this "Wonderful" group and the multi millions of dollars that put smiles on their faces while Kansas children pay the price, even unto death!
